Лексико-граматичні особливості перекладу німецькомовних текстів у галузі юриспруденції

Abstract

(uk) У роботі розглянуто та проаналізовано особливості юридичних текстів німецькою та українською мовами. Висвітлено лексико-граматичні особливості німецьких юридичних текстів та способи їх перекладу українською мовою. Окреслено поняття, види та роль юридичного перекладу, охарактеризовано етапи та принципи перекладу юридичних текстів та їх особливості, які повинен знати професійний перекладач; визначено особливості цих етапів у перекладі юридичних текстів. Юридичний переклад – це мовно-юридична процедура, а отже знання перекладача текстів в галузі права мають бути не лише мовні та перекладацькі, а й юридичні.

(en) The peculiarities of legal texts in German and Ukrainian are considered and analyzed in the paper. Lexical and grammatical peculiarities of German legal texts and ways of their translation into Ukrainian are explained. The concept, types and role of legal translation are outlined, the stages and principles of translation of legal texts and their peculiarities, which a professional translator should know, the features of these stages in the translation of legal texts are identified. Legal translation is a linguistic and legal process, so the knowledge of a translator in the field of law must be not only linguistic and translational but also legal. The types of legal systems of the world and their impact on legal translation have been clarified, the legal systems of Germany and Ukraine are described, they belong to one Romano-German legal system, but still have many distinctive features. The author outlines necessary background knowledge for a translator of legal texts. The peculiarities of legal translation are outlined, the lexical and grammatical features of German legal texts and the lexical and grammatical transformations used for their translation are specified. Lexical peculiarities are first and foremost the use of terms, clichés and abbreviations, while grammatical ones are the use of means of expression of duty, condition. A special structure of sentences of legal texts is revealed -frequent use of complex common sentences. These peculiarities are often combined and demand the usage of lexicalgrammatical transformations for proper translation: antonymic, descriptive translation and compensation. The features of legal text within the official business style have been clarified. Legal translation must meet the requirements of official business style: compliance with certain mandatory means and ways of expressing information and constructing a text; preservation of formality (strict, clear, emotionless, not figurative presentation of information,); impersonality (the text appeals to everyone, not one person).
